4. Facebook Integration

Our services integrate with Facebook to provide enhanced functionality. When you connect your Facebook account to our services:

• You agree to comply with Facebook's Terms of Service and Community Standards

• You acknowledge that we are not responsible for Facebook's policies or practices

6. User Content

7. Intellectual Property Rights

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, secure, or error-free, or that defects will be corrected. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any content obtained through our services.

You acknowledge that your use of our services is at your sole risk. We do not warrant that our services will meet your requirements or expectations.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREYT INC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use our services

• Any conduct or content of any third party on our services

• Unauthorized access, use, or alteration of your transmissions or content

• Any other matter relating to our services

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Freyt Inc, its officers, directors, employees, agents, affiliates, and partners from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your violation of any third-party rights, including intellectual property or privacy rights

• Any content you submit or transmit through our services

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in our application. Upon termination, your right to use our services will immediately cease.

14.2 Termination by Us

We may suspend or terminate your account and access to our services at any time, with or without cause, with or without notice, effective immediately. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent or illegal activity, or extended periods of inactivity.

14.3 Effects of Termination

Upon termination, all licenses and rights granted to you under these Terms will immediately cease. We may delete your account and content from our servers. Sections that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, indemnification, and limitation of liability.

15. Dispute Resolution and Arbitration

15.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We will attempt to resolve the dispute informally by contacting you via email.

15.2 Binding Arbitration

If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

15.3 Class Action Waiver

You and Freyt Inc agree that any proceedings to resolve disputes will be conducted on an individual basis and not in a class, consolidated, or representative action.

16. Governing Law and Jurisdiction

Freyt Inc shall not be liable for any failure to perform its obligations under these Terms where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation, acts of God, war, terrorism, riots, or natural disasters.
